White Paper: Court Clears Ex-Kaduna Commissioner

A Kaduna State High Court sitting in Kaduna yesterday dismissed a case brought before it by a member of the Peoples Democratic Party (PDP), Mathew Reuben Anze challenging the emergence of a former commissioner of Women Affairs, Mrs. Comfort Amwe in the 2014 House of Assembly primaries of the PDP.

The former commissioner who had won the primaries to represent her people at the Kaduna State House of Assembly, went ahead to win the April 11 general election, but was not sworn in based on the court case instituted by Hon Anze.

Mr. Anze who came 4th with two votes after the primary election approached the court to declare that the former commissioner was not qualified to contest the election by virtue of section 107 (1) (H) of the 1999 constitution as amended by the "reason of her indictment by the administrative panel of inquiry and white paper issued thereon."

Delivering her judgement on the matter, Justice M.L. Mohammed dismissed the case for lack of merit.
The court which relied on the same section 107 of the 1999 constitution as amended and section 104 of the evidence act, ruled that the exhibit brought before it are not truly certified, "because there is no evidence to show that the plaintiff comply with section 104 of evidence act
